I received a reply from the American Philosophical Society and we may use this image, but under permission. I mailed the necessary paperwork this morning, and will post a scan of the permission as soon as it comes back with the proper signatures. That's a great image of Boas, and there's no doubt the copyright has expired. However, the American Philosophocal Society may still retain a proprietary right in any derivative image from an item in their collections.
The APS's own website states:
"Copies are prepared solely for the use of the researcher and may not be placed in other repositories without the prior written permission of the APS"
They do not have a clearly articulated policy on electronic images from their site, but I fear that "other repositories" may be interpreted to mean online ones. I would urge that you get a clearance from them to use this image.
p.s. I have other images of Boas in my collections that you could use if wanted. Russell Potter 10:17, 6 May 2007 (CDT)
